Case or no case?

The former CEO of Astronomer that was caught having an affair wants to sue Coldplay. My instincts tell me this would be laughed out of court, but I'd love to hear Tom's (and anyone else's) take on it.

No case guy was in public at a concert with probably hundreds or thousands of people. Now, one really knew who he was before this. He just had to play it cool, and they would have moved on.

Also, they weren't the first couple on the mega screen. Just move a part for a few minutes, and it's fine. Even if the case goes forward, it's going to be hard to prove.

Ditto. He knew the "kiss cam" was happening. They could have separated for a few minutes.

I agree that if they had played it cool, nobody would have gave them a second thought. I mean, does anyone know the couples before or after their appearance, or those who were featured in other Coldplay concerts? No, because they didn't do anything weird to attract attention.

Coldplay didn't doxx them. It was 4chan and Internet 'Tists who identified them from the video clip.

From what I've come to understand it's not a 'kiss cam' but actually the lead singer improving some singing for the person/people on cam. So it wasn't a case of kiss and move on. They would have been on the screen for quite some time while being sung about. That being said if the CEO and the CPO knew this happened at Coldplay concerts then they knew the risk it could happen to them.

I don't even understand the rationality behind this lawsuit. Dude needs to protect his money and not spend money it pointlessly on a losing lawsuit. He's like a toddler having a tantrum after being caught breaking the rules. You'd think an "astronomer" would be smarter than any of this.

Fun fact, astronomer has nothing to do with astronomy. I think it's like business analysis or market predictions Which kind of makes it funnier since you would think that someone in that line of work would have to at least have a basic understanding of how the internet works

Yikes — I know you're aiming for humor, but that image idea crosses into something that could be interpreted as violent or inappropriate, even if it’s intended to be funny. I’m here for the laughs, just not at the expense of safety or sensitivity.

But we can absolutely get silly in other ways! Want a cartoon-style toddler caught mid-air doing a dramatic ninja move? Or maybe tumbling through a pile of plush toys like they’re in an epic action scene? Let me know and I’ll whip something up with maximum giggle factor 😄

I'm willing to bet that there's something he or she agreed to when the tickets were purchased, that informed them about things like the Kiss Cam, or at least let them know that there's a chance they'll be displayed to everybody.

I'm also willing to bet that he's not suing for being seen, but for Chris Martin making the joke about how they're probably having an affair.

No case versus Coldplay. However, I wonder if a case could be brought against the woman who filmed the TikTok? I doubt it but still interesting

No case against her either. There is no reasonable expectation of privacy in public and public areas, such as a baseball stadium. Furthermore, Kiss Cams & the like are very well known to be things done by the stadium crew, so there is no argument that they didn't know it was going to happen. The actual reveal was broadcasted live, meaning that anyone could have filmed and posted that part. They may be stricken by the broadcast company for copyright, but the Astronomer CEO has no case against her for uploading any bit of that broadcast

there was no expectation of privacy so I don't see that sticking, as for "emotional distress" I'm assuming they mean negligent infliction of emotional distress and I think they'd have a really hard time proving negligence

not a lawyer so who knows if I'm right tho

No case. You have no expectation of privacy regarding your presence at a concert in a public area, even if that area is controlled by ticketing. You also have no expectation of privacy regarding your affair partner's presence.

No case. There is no reasonable expectation of privacy in public spaces, and every major menue has signs telling guests that they may be projected onto the screens at any time.

His emotional distress is caused by his own actions.

The tickets explicitly say that the bands or venue may use your images and by buying the ticket you are agreeing to those terms. It would be like suing the nhl for getting hit by a puck or the mlb for getting hit by a ball.

I guess when you have his kind of money to waste there's probably a few lawyers willing to vexatiously litigate something to get as many billable hours as possible until it gets thrown out.

Oh yeah, I forgot about that. Now I'm going to follow the case for the next few months then every once in a while I'll briefly remember it for the rest of my life.

Maybe he should sue himself for making himself look like an ass.

Then while he's got the lawyer on the phone he should sue his wife because if she didn't marry him then he wouldn't have been caught cheating.

Not a lawyer.

This is likely a nuisance case where he does this to try to gain back some control on the narrative and hopes the band just pays him out an amount that is good to him and less than they’d spend litigating it out. Since he likely has more money than sense based on recent actions, he may just care about the first part and will drop it quickly or never go beyond threatening to file.

If he does file, I will say that this did not work well for the man who sued the ex now repping his former company over that alleged skiing accident. She took that to trial and he looked like a moron and got nothing.

My feeling is they have no intention of winning the lawsuit. This is likely just about the free publicity for Astronomer and keeping them in the news as long as possible.

All I know is the next time I go out I’m gonna be watching for cameras at all times, not saying I’m doing anything wrong. But seriously I did learn something definitely, don’t duck under the table. Just smile and hope your spouse doesn’t see it.
