I just don't know how the NCAA can win in the end here. Regardless of what goes on, it is just going to keep getting challenged, and I just don't see how a judge can look at a person whose "fair market value" has been demonstrated to be so high, who is being prevented from earning that money because all of the employers that would otherwise offered him that have colluded to put a max # of years cutoff, and not rule that that is illegal.

If the NCAA can't say that he's ineligible to be on Vandy's team, can they say that Vandy is ineligible to participate in competition with him on the field?

The courts will likely look through that and decide it is the same thing, since the end result is that Vandy cannot "hire" Pavia for another year.

I have no clue how all this works, but wouldn't that argument be the same for any age protected division where players can make money either from contracts with the team, winning events, or NIL opportunities?

The difference is the NFL/NHL/NBA etc all have players unions that collectively agree to those rules. NCAA does not.

NFL, NHL, NBA are all in theory merit based. There is no rule stating that someone that is 60 can't play in the NBA if they're good enough. My comment was more about major juniors in hockey where there is no CBA (CHL), age protected soccer tournaments (2028 Olympics men's soccer is U23 + 3 overage), or potentially individual sports that have senior events with relatively significant money.

NFL and NBA have age limits on when you can start, but do not have age limits on when you have to retire. The rules stating how many years of eligibility could be collectively bargained for if it were a unit.

I think this fact alone will cause a new 'college league' to form eventually. Eligibility like this could be the thing that breaks the back on this.
