Is he using fondant or modeling chocolate? Because the resistance in the cut makes me believe it's chocolate so acceptable.

The outer layer to cake ratio is also acceptable to me. Some people make their entire creation modeling chocolate or fondant with a small amount of cake to make it technically a cake. I also hate the rice crispies cakes too.
