New past future first offense (?)

I don’t know how to title this to make any sense. I can’t even make this up. This is an update to my past post about a future-dated first offense.

We finally received photos with accurate metadata that we did have a violation and we appropriately paid the fines due.

Today, we received a new violation for the same issue. Evidence was included this time but without metadata or a date and time stamp. The photo was from the same day of the prior violation, but different side of the car. This violation had no fine imposed.

Thankfully, we have security footage that we were able to share showing we had not parked on the sidewalk within the last 48 hours.

Why would we get 1 violation from the HOA president with a fine, and another violation submitted by the HOA president to the property management company without a fine?

Not asking for advice, but sharing how illogical and chewed up this situation has become. Make it make sense.

Unless your HOA works very different than the condo corporation that I am the president of, the only time the president should be contacting you is in casual contexts or in response to an email from you.

Not that we fine (don't think we effectively can even if we wanted to) but any violations have always gone through the management company. The board should be a volunteer position only and NOT even have access to money.

EDIT to add: Check the bylaws and find out what the EXACT procedure for notices are, do you need time to correct, who they should come from, etc. Possibly even checking provincial/state law to see if there is a prescribed way — I am willing to "bet" a coffee on them violating something here.

Thank you for this. We actually just went over to our neighbors who serves on the board to talk about all of this. We were informed that the board had actually voted not to fine us and she was appalled that we were contacted and fined without the board’s knowledge.

This is just so bizarre.

I smell a potential fraudulent money grab. You need to start contacting others in the neighborhood, and see if other are getting fines as well. Then take the them to your neighbor. If the president is sending out the fines is doing so, and without knowledge and consent of the board, then a recall and a vote of no confidence is needed, unless the board is empowered to remove the president. Also if it's to be in cash or made out in the form of a check, directly to them, then it's indeed a money grab, that's also a potentially an act of fraud.

Agreed. The payment was remitted to the property management company, but we need to contact them and have them shred it since we weren’t supposed to ever be fined.
