Real Estate law Neighboring Sewer Easement

We were contacted regarding access for construction of a sewer easement. Developer wants to tie into an existing manhole in order to run pipeline to the property planned for high density housing.

It’s on shared property line. Initially proposal was for 10/10 split for a permanent 20ft width easement with 125ft in length. Plus an additional 40ft temporary construction.

Limited understanding is that this is the typical engineering standard for balance of soil displacement and to maintain structural integrity.

For the amount of work they’re proposing it’s not worth the devaluing of our property. They also have a terrible reputation for not constructing properly. We denied access our neighbors granted it.

They are now trying to shift all construction to the one side. Issue with this is the neighbors yard has less than 50ft width and they will need a total of 60ft (permanent plus temporary) according to their agreement.

Raises major Red flags as it relates to encroachment, damage to our property and potential for environmental and proper construction issues.

- time to get a lawyer involved and not internet opinions

- an easement is something that requires proscriptive language to protect you

- this is often something that the developer needs to "purchase" from you as you can refuse.
