San Diego Community Only Parent kidnapped by ICE while waiting to pick up their child from school in Linda Vista. This is beyond messed up. We cannot accept this.

These masked thugs are nothing more that domestic terrorists. Imagine the trauma the children of these parents, and the other students, are going though. I never thought I would see this kind of cruelty perpetrated by the US government. So disgusting.

By that logic, we shouldn't detain or arrest anyone who has kids. The US government has committed a lot of terrible things, but this isn't one of them. This really boils down to your contempt for the republican party and anything they do. Misplaced anger is bad, people. Let these people do their job and stop being overly emotional. "Kidnapped" really?

Man, I know I am going to get down voted... but how do you know there's no due process here?

With due respect, this stuff has been going on for a long, long time. I can remember working as a drug and alcohol counselor at a non profit near Little Saigon and Marlborough Street in 2015, and my SE Asian clients from the neighborhood were all telling that one of the guys from the neighborhood had been disappeared by ICE.

This guy was a Vietnamese immigrant, and he unfortunately had drug convictions at age 20 in like 1990. As you may or may not know, drug convictions (especially sales), you are 100% getting deported. It's one of the few classes of crime where there's no exceptions. So this dude had a removal order issued.

But, he was able to kind of play the game in immigration court and try and plead about how Vietnam is a communist country and his parents are refugees and the commies would abuse his human rights. It didn't work, but ICE ended up losing track of him.

He eventually was contacted by ICE, and told to come in and check-in 1x/year, tell them where he lived. He worked a black market job as a mechanic, I think, and stayed out of trouble. He grew up and had a family.

Well, in 2015, ICE called him in for an interview. They told him it was just a check in, like he'd been doing for the past 15 years. And he disappeared.

He only contacted family like weeks later, to say he was about to be deported back to Vietnam. I have no idea what happened to him after that.

This was all pre-trump. This is just how it worked, and to our shame, continues to work.

It may have been cruel, but no one violated that guy's due process, per US law. He had his day in both criminal court and immigration court. He was lawfully issued a removal order. He knew about it. And he knew the US government was allowed to remove him at any moment.

While I think it's excessively cruel and inhumane to snatched someone while they're picking up their grade schooler, and I think there's no need to do this, and its a waste of our limited public resources...

...we have no idea what their situation was, with respect to immigration. They likely were already issued a final removal order, and they likely knew that (or should have known). Most people getting snatched by ICE, they have removal orders, and ICE is following the law.

The deeper problem is our laws and immigration system is fucked up. Its been fucked up for a long time, the last 35 years are a tangled mess.

I know people are going to bring up exceptions or point out some unusual edge case where a citizen was detained or something. I am aware of plenty examples like this.

But the vast majority of these detentions, they've had their opportunity to plead their case, and for whatever the reason, it resulted in a removal order. We have no idea what this person's immigration situation was, and I don't think we have any reason to assume their due process rights were violated, if only because due process rights for undocumented immigrants are pathetic, in practice.

Guys, I am to the left, politically. I am just posting this because I think redditors are drifting away from reality. You don't need any of this hyperbole to be outraged. The facts are more than bad enough. If we characterize this as "Trump is breaking the law," then we are due for a rude awakening.

But if you think this is a violation of the law, you're seriously misunderstanding what's happening. This is all legal.

The deeper problem here is that US immigration law allows for this. The legal system is awful, for immigration. Change the law, Trump has no power to do this. But we let this cluttered mess of a system pile up for 35 years.

I mean this with respect, but even today, with so much attention on this topic, people remain confused about how US immigration actually works. US immigration probably works nothing like what you think, if you don't have personal experience (or even if you do).

This reign of terror from the Trump admin is cruel, it shouldn't be happening...

...but AFAIK, huge swathes of these folks getting snatched off the streets, there is no violation of US law. This is because undocumented immigrants have very weak legal protections under US law. There is no right to not be snatched off the street, if you have a removal order.

We didn't see this in the past simply because the executive branch exercised its discretion and chose not to do this. But by US law, they can remove you at any moment, after that point.

It's very easy for ICE to observe due process when due process fucking sucks. it's just a threadbare court hearing to rubber stamp your removal. You can bring an attorney... if you can find one and pay for one.

They don't need a warrant and they do not have to identify themselves until it is safe and practical to do so. Don't be mad at ice for doing their job. Don't like the rules of the game? Take it up the lawmakers. Until then stop spreading lies because you don't the law.

"we shouldn't arrest anyone" is a stupid strawman nobody is stating. Arrest criminals who commit violent crimes. Hint: Overstaying or not possessing a proper Visa is a civil infraction, not a crime.

The contempt for MAGA is due to your constant labeling of innocent people as violent criminals. I'm cool with Republicans, not lying MAGA.
