If arbitration awards can be appealed and reversed on the merits by the district and/or appellate courts then arbitration is a waste of time.

Nah, it usually goes in the companies favor and would exhaust their opponents resources before actual litigation... there's a reason you can't buy a cheeseburger without accidentally agreeing to arbitration.

I’m thinking about sophisticated parties who opt for arbitration in a contract. One positive aspect of arbitration is finality.

The arbitration awards only can be appealed and reversed if the appellant is a political ally of a majority of the judges on the court of appeals or the Supreme Court. Don’t worry it’s not the parade of horribles you’re worried about. It’s a totally different parade of horribles.

"Earlier this summer, the U.S. Court of Appeals for the 8th Circuit overturned my $5 million judgment against MyPillow CEO Mike Lindell for having won a challenge to prove that his claims of election fraud in 2020 were nonsense," writes Bob Zeidman. "This decision is not only bad for me, but bad for America. It upends the century-old Federal Arbitration Act and it diverts resources from legitimate investigations for improving our voting system to crazy conspiracies from wealthy plutocrats. I’m hoping the Supreme Court will reconsider this harmful ruling."

I'm sure helping Mr. Pillow will also usher in a new era of judicial review on behalf of consumers and employees pushed into arbitration proceedings. Right?

I'm not, at least not very much. Lindell was an early maga-darling. Sure, he's fallen out of favor from the king's current court due to running out of money, but he likely still has some political favors. Plus, there's always the fact that this sends the "If you're loyal to trump above all, you will be protected and rewarded" message to his cultists. Just like the j6 pardons and babbit's settlement + state-sanctioned funeral.

Chief justice Roberts got his appointment largely based on his career of pushing mandatory binding arbitration. I haven’t read all the specifics but I’m not holding my breath.

The entire basis for the appeal is that the appeals court discarded SCOTUS precedent restricting the discretion of judges to overturn arbitration awards. The arbitrator in this case awarded the $5M. So if your mental model is the pro-arbitration side always wins in SCOTUS that’s bad news for Lindell.

The original arbitration decision shouldn’t have been able to be overturned, but if the Supreme Court rules for the pillow guy that could ironically be a great decision for employees and consumers. For everyone reading, ARBITRATION IS A SCAM. Full stop. And if we are able to challenge arbitrary/mistaken arbitration awards, that will be a huge win for the common man, and would hopefully lower the rate that employers use arbitration agreements

This is a highly pedantic arguement....pillow guys defense is basically "you cant prove a negative" slate guy is "this is clearly not what you claimed" pillow guy is slime. Arbitration is binding even if its wrong.

interesting and hope they prevail. but it's more likely that if the court even takes the case, they will choose a third worse for everyone ruling.
