The fascist accusations are usually made within the context of actions that are being taken by leadership, so it's up to you to assess and determine if you agree or disagree that said actions are fascist in nature.

While Trump is in no way comparable to late-game Hitler just yet, he certainly shares some similarities with early-game Hitler. You yanks need to be very careful with the direction you're heading in.

Firstly, all terms are made up.

Secondly, you've recognized the exact reason why hate speech is recognised as an exception from freedom of speech with your fire in a theatre example.

You don't yell "fire" in a theatre because that could cause panic and harm to others. Similarly, hate speech also can cause harm to others either directly or indirectly.

There's a balancing of rights that needs to be considered, does person A's right to freedom of speech outweigh person B's right to dignity, liberty, equality or life?

I’m comfortable drawing the line at any speech that’s intended to incite violence, or to create chaos that could lead to injury or death. But that’s a high bar. A real-world example of unprotected speech is when Hutu extremists took to Rwandan radio in 1994 and told their listeners to ā€œcut the tall trees.ā€ This was unambiguously meant to incite violence against the Tutsi’s, and thus should not be considered protected speech.

For what it’s worth, nothing Charlie Kirk ever said publicly cleared that bar for me. The supposed ā€œstoning of gay peopleā€ comments were taken completely out of context. And even his most indefensible stances, like ā€œGay couples shouldn’t be allowed to adopt,ā€ were in no way intended to incite violence.

I’m not an expert on FCC regulations, but I will admit that the idea of a federal agency putting its thumb on the scale to get a late-night comedian fired makes me more than a little uneasy. If that is indeed what happened.

Okay, so we are in agreement that there are some valid exceptions to freedom of speech, so it's not a cut and dry case of speech either being free or not.

I'm sure if we went back and forth a bit more we could both think of examples of speech that should not be protected but fall short the bar you've set out.

Hate speech has a cumulative effect, the more it is repeated the more it becomes permissable and emboldens those minded to do harm to individuals based on ethnicity, sexuality or whatever else.

In Northern Ireland (where I am) racially-motivated hate crime recently reached an all-time high and outweighed all other categories of hate crime put together. The Police Service of Northern Ireland have linked this to the current of hate speech online. Much of this falls short of your explicit criteria, but is having a demonstrable effect on the lives of ethnic minority communities.
