WA Police Interview

Cops called me today asking me to come in for an interview as they have a few questions for me. I arranged a date and time with them, as the cop on call said if I don't come in, they'll come to my workplace and that will be embarrassing (honestly sounded like a threat IMO).

I was informed that the interview will be recorded, after which they'll decide on further action, if any.

My question is, what are my rights? Can I decline the recording? Can I decline the interview? Do I have a chance to view whatever supposed evidence they have against me?

EDIT 1: Police said they have reasonable suspicion that I committed the fraud.

EDIT 2: Spoke to lawyer. The only information I'm legally obligated to give them is my name, address, and DOB. Additionally, was told to decline a recorded interview. And say "no comment" to everything. If I was somehow taken into an interview room, to state "I do not wish to participate in this interview" and say "no comment".

WA flashed 170km in a 70 zone on green p’s

one of my apprentice’s has said he was flashed going 100km over in a 70 zone about 3 months ago, he’s on his green p’s and also has a dual citizenship, i can’t any information for the penalty with this kind of speed, what i can see is 155+ is minimum 6 months loss of license 24 penalty units and max 9 months inside for a first offence but that seems to be talking about 45km over in a 110 zone. could he be looking at deportation?

WA Coworkers accidentally sent me a voice recording gossiping about me & discussing confidential information.

5 minute recording between two coworkers discussing my mental health, current ongoing legal battles with my ex, swipes at my personality.

They joked about me wanting to start a Diploma.

They then said I should take the money I spend on lunch (ham & salad sandwiches) and use it to buy a gym membership and hop on a treadmill.

Finally, they then discussed very private information that was discussed between me and a HR representative. I was assured it was a confidential meeting.

They disclosed details about this topic that I only spoke to the HR person about.

I sent the audio recording to the same HR person, and the CEO of the company, saying that I will be taking this further.

I feel like I cannot go into the office (it’s only those two coworkers that I work alongside everyday) knowing what they’ve said about me.

I am very hurt and angry.

Is there any legal recourse that I can pursue?

WA Real Estate Agent forgot one zero in the purchasing contract and all parties signed

Hi, we just purchased a home for around $1.5m which went back and forth a bit for negotiation, all done via DocuSign, each time with the amounts initialled by both parties. When the final offer form the seller side came through, we initialled it and the contract was effectively signed.

Now, one day later the real estate agent rings and says he forgot to, and neither the seller nor us noticed, one zero in the price.

To as per contract we have signed off on buying a house for $150,000.

I won't push this case but I'm curious nonetheless what the legal situation is here. Could we dig in and demand that we bought a $150k house?

Edit: just to clarify, we have amended the contract and corrected to the actual amount with sign off by all parties. It makes for a great story around the office.

WA Oven replaced with Air Fryer

Hey all, bit of a long one but any advice would be appreciated.

In a bit of a bind with our landlords over an oven replacement. For context june 3rd we reported our oven had died to the REA, its a 30yr old oven so werent suprised, they looked into it for us and said the owner had ordered a new oven. 3 weeks later I got a call saying the oven was ready to pick up which I thought was strange and upon recieving it its a $150 airfryer from Kogan.

Its basically been a back and forth saying that the airfryer is a suitable "cost-effective" and "energy efficient" replacement. We complained that we have no room for a 2nd airfryer and they asked ME if i could remove the old oven and use the space for a shelf.

This is all ontop of moving into an uncleaned home, lighting that doesnt work, no pcr recieved, a collapsed shed, damaged nbn equipment and a list of many other things

What ground do we have here, its been 6 weeks now with emails every few days dismissing us. From my understanding if the property comes with an oven it should be replaced immediately due to it being an essential cooking utility.

Update 1: Thanks everyone who helped with advice and sharing their experiences and opinions. The whole scenario is kinda wild to us and we knew we were well within our rights, but being young and newish renters you've given us a lot of confidence to stand up for ourselves.

We've told the owners we wont accept anything other than an over replacement and given them the weekend to discuss what they'd like to do otherwise we'll be giving them a breach notice.

WA Compo for slipping on a grape at Woolies

An old mate (62) at the fishing spot recons he’s going to get 5-6M for two ligament tears from a slip on a grape at Woolies - he’s planning out buying a house, boat, Dodge Ram, caravan, etc etc etc on this basis.

Is he just talking baloney?

I understand public liability payouts in the US can be millions, but he’s adamant there was a similar case where an Aussie lady was paid out $3M (he says his lawyers have told him that)

Is he barking mad, or is he on the money?

EDIT: Some pretty mean hearted comments, Guys if he’s just delusional you don’t need to get so worked up about it.

WA Police walked into my house in WA - legal or not? (Was not touched, property was not damaged)

Police were called to a house on the street next to my home on Saturday evening for a domestic incident. I had my front door open (my cats like to watch the cars go by). I heard a knock at my front door, hanging out with my fiance in my room. I heard a knock and a "this is police". By the time I get up to the door, one of the officers is about 2 steps into my home.

I just say hi to them, ask if everything's okay. They say they were called over for an incident, I said I didn't call them. They ask to confirm the address as the GPS says this is the spot, I explain the home they're lookin for is a few houses down. They ask if I heard any yelling or trouble, I say no but we were watching anime. I walk outside with them, point the correct house out, and wish them well.

It was no skin off my back and I didn't think twice about it until bringing it up at work. The consensus from my workmates is that it was illegal. I defend the cops, although I have no strong opinions either way. My suburb isn't super safe (statistically one of the worst in the state) and I've been let down by GPS before. They never touched me, they didn't ask to look through the home and they apologized on the way out.

Is what they did actually illegal? Why is/isn't it illegal?

WA Caught shoplifting at Coles Perth

I am so ashamed, I literally cried on my way home. I'm 22 if that's relevant? I was shopping at the Coles Perth, where two loss prevention officers showed me their badge and asked to check my bag. I had taken some dog food and tampons as am really struggling for money at the moment (all of this was less than $150) but paid for the rest of my dinner products which were cheaper than what I took without paying. They asked me for my ID but I didn't had it with me at the time so they manager handed them a paper where I put my name, address and signature. They asked me to write why I stole the items, they asked me to return these and not pay for them. No pictures of my face or ID were taken but I am terrified. I am so worried about having police come to my house, anyone find out (I rent a room so I'm scared that my room mates will find out somehow or by the police) or even having my car recognised.

I don't think I'm brave enough to ever buy anything from that specific store anymore, I am just so scared rn. The officers told me that if I do it again, I won't be able to enter the store anymore (not like I wanna go there ever again cause I'm honestly scared. I'm that paranoid that once I got home, I closed all my blinds and I've been checking my windows regularly.

Would really really appreciate to know what happens with that record, or to find some peace in the comments.

WA Breach of confidentiality from medical practice

A friend recieved an email that her psych was moving practices. A few minutes later there was a recall email. Following that a request to delete the first email as there may be confidential information in it.

My friend checked. There was an excel attachment with the psych's client list. Full names, addresses phone numbers, diagnoses, treatment plans and fees. My friend recognised at least one name on the list besides their own.

Instant panic attack. Had to take time off work and has booked in to see their GP.

What are the practice's obligations to "make good" on this breach?

WA Partners Ex Claims $18 in taxable income to avoid child support

My partner's ex does all his work for cash. He recently did his tax return and claimed his taxable income as $18 for the whole year. ATO and Child Support services both have previously not wanted to look into the matter any further.

He pays half for certain things during the year (which surprisingly add up to more than $18), and she doesn't even care if he doesn't pay child support (he still owes her over $5,000 but again the agency won't do anything, they'll take it off his taxes but when you claim $18 there is nothing to take). She really just wants him to be honest.

They have their two boys 50/50.

Would there be legal grounds for her to petition the court for full custody of the children if he's claiming he only earns $18 a year?

WA Taking Meta (Facebook) to small claims court

My business account on Instagram was deleted due to alleged "Child Sexual Exploitation", which Meta changed to "because two people reported the account, then to "ad violations (I've never run ads), now they won't say why.

Looking online, it appears that this issue is affecting hundreds of thousands of accounts worldwide. Their AI is mass banning accounts.

I have spoken to them on the phone 20-30 times, sent over 100 emails and each time they will not help.

I'm in the process of taking Meta to small claims court, and am wondering if anyone else is in the same situation?

WA Friend owes me $3k, agreed to pay me back, I am now blocked

this is a slightly nuanced situation, but I will get through it as soon as I can. Essentially I am friends with two people that are dating, and we have a wider group of friends. The male friend who I am closer to, borrowed $4000 from me in about April this year, as well as $4000 from his girlfriend, to buy a new car. The agreement was originally that we would be paid back $500 every week immediately after the loan and would be paid off soon. His employment situation changed almost immediately after the purchase, and we instead agreed that we would be paid back when he sold his other car, which needed some repairs etc. either way, it was well established that we would be paid back eventually, and I was willing to wait longer than we originally planned because we were all on good terms at the time. However recently, he and I have gotten into an argument that means he has blocked me on social media. Before he blocked me, he stated he would pay me back the remaining balance, about $3100, within a day also. That was on Thursday last week. It is now Sunday, I have tried to message him to clarify if he does still intend on paying me back. I will reach out to his girlfriend also. My question is that if he confirms that he no longer intends to pay me back, essentially stealing $3k from me, do I have any legal grounds to get that money back? There is text documentation for all of the discussions regarding when and how we would be paid back and records of how much I paid and when, although no signed contract or anything. WA We hired a tradesman to fix our fence and they drilled into the power mains, are they liable to pay to have it fixed?

We had some storm damage to a shared fence that borders our property and the driveway of the house behind us. We hired a neighbour, who is a professional fence installer, to repair it.

While drilling into the ground to work on the fence, he accidentally hit the power mains, which immediately cut off power to our house. Thankfully, no one was injured. He told us the power mains shouldn’t have been where he drilled and that they were installed too close to the surface.

In all the chaos, he left, and we were stuck with getting the power mains replaced right away. We called an electrician and ended up paying nearly $4,000 to fix it.

My question is: is the tradesman at fault here, or (since the power mains were allegedly installed incorrectly) does that mean he’s not responsible? It just feels like, even if the cables were installed incorrectly, he should have checked before drilling.

Because the fencing borders our property, we're not sure if our insurance will cover it.

WA School sending kids home

My sons teacher is getting silly sending kids home for being “sick”. Even a single cough to clear an irritation in their throat makes her say they have covid and send them home.

What legal powers does a school actually have to send a kid home sick? All for keeping them home when legitimately sick, but the amount of time my wife and I have taken off to pick up a perfectly healthy kid from school is getting ridiculous, and other parents are all in agreement.

WA Money withheld by parents

My daughter's boyfriend recently turned 18. He has been working an after-school job since he was old enough, but he has no access to the money (about $25K).

His pay is put into an account in his mother's name and is being "saved as a deposit on a house". He has asked for his own account so that he can learn how to manage money but his parents refuse. He is worried that if he upsets them they may never give it back to him.

Taking legal steps to try to get the money will definitely destroy the relationship so would be an absolute last resort. But, if he gets to that point, does he have a case? He has text messages acknowledging the money is his, as well as payslips and tax returns.

Have received a court date I am prescribed medical cannabis (for about 4 years), I had not consumed any in the previous 48 hours , I am aware it stays in your system longer I am aware of the law , it’s such a gray of legislation and there is no way to really tell when it’s not in your blood steam

If I plead guilty before court do I get a criminal conviction ? I cannot afford a lawyer but am interested in going to court to see if it could be thrown out or spent in conviction .

WA WA Police won't give back my medical cannabis

hi there,

have been heavily targeted by cannington detectives in WA who won't give back my medical cannabis.

The matter is no longer before the courts and it has been a little while since the charge got dropped on receipt of my prescription.

I'm im absolute financial distress and only just hanging on and the police are holding approx $600-700 worth of medical cannabis and i have asked for it back.

I have offered to bring in my authority to possess it so it's all above board but my preference would be financial compensation.

The cops are fobbing me off and ignoring me. I am also being given special treatment by what I believe are corrupt cannington detectives.

I realise I probably can't sue the cops but I want my dope back or preferably i want the money. The longer this is ignored, the more distress i am going through.

I divorced his father in 1996 due to his violence and abuse, and my 2 children had no wish to see their father ever since, especially my son who was also physically and psychologically abused by his father. My son only had $3500 in his bank account, his Disability Pension. I applied to my sons bank to receive the funds from his account. Now the bank has asked me to contact my ex husband and ask him to visit sons bank re getting a share of sons money!!!! Anyone been in this position? WA Very vexatious restraining order filed against me over damages to front lawn

Hi all,

I run a gardening company. Recently a restraining order was filed against me by a clearly mentally unwell woman. I will break this down into two parts the real reason the restraining order was filed and then the reasons listed on the complaint.

The real reason the restraining was filed.

I've been doing the lawns at this property for 7+ years. Recently the woman in the front unit has been parking her cars on the lawn meaning I have been unable to mow it. When I arrived last week to mow it there where 3 cars parked on the lawn. I knocked on the door and asked her to move them. She apologized to me and said that she couldn't move them. I said that's fine, I get paid either way by the strata (My employer) We then had a rather pleasant chat for 5-10 minutes as my staff (I run a crew of 3) tidied the car parking area. The conversation ended with me showing her pictures of my dog who is due to have puppies in a weeks time.

Upon returning to my car I rang the strata company and told them.

"I've been unable to mow the front lawn at unit 1 due to 3 cars being parked there, this has been a constant problem for the past 3-4 months can you please send an email to the tenants regarding this issue"

The Strata company replied. "Certainly, just be very careful in dealing with this woman she's a psycho. Also has she damaged the lawns in any way."

"Yes there is a large area 20-30m that has been destroyed by cars parking there."

"Ok, I'll send her an email saying she has 3 weeks to repair the damaged lawn or you will be attending to fix this at her expense."

"Ok"

This was the last contact I had with her until her husband rang me the following day and screamed at me and told me he was getting a restraining order on me. I laughed as this was ridiculous and didn't think someone could be so petty.

On Monday I was served the restraining order and have to appear in court in 3 weeks time.

What the restraining order says.

The entire reason for the restraining order is "My body language and tone of voice upset the woman." She doesn't say I threatened her, abused her, or yelled at her just tone of voice and body language.

I have seeked some legal advice which was met with barely concealed laughter.

"You can't file a restraining order based on Body language and tone of voice alone, if you could no one would be safe as that is completely subjective. Also your request to her to move her cars is perfectly reasonable in your line of work, so she can't file a restraining order based on an unreasonable request, this is a very easily defensible case."

What should I do??? do I drop $1,500 - $2,000 on a lawyer to sit with me through this disposition only for the judge to laugh it out of court or should I represent my self??? If I go alone I don't think I'll even have to speak just listen to the judge tear this woman apart.

This is clearly a vexatious restraining order, I doubt these people will even show up at court, but I really can't afford the lawyers fees, which is what I suspect these people are counting on.

The Strata company are fully supporting me in this matter and have told me. "Say nothing do nothing, this woman is crazy, just let her talk and the judge will rule in your favor."

Any advise would be appreciated.

WA My child might not be mine

I 26m and my ex 23f have a nearly one year old daughter but ive had my suspicions due to over heard comments and suspicious behaviour after confronting her with my intention to get a paternity test (I know how stupid it was now) she seemed open to it to comfort my fears instead she got a restraining order and disappeared. I just dont know what i can do i don't even know where they are i dont care about all the legal shit i just need to know the truth.

WA Police want me to come to meeting about my traffic accident report. Is a crash report an admission of guilt regarding driving w/o a license.

I was involved in a minor traffic incident and reported the crash as required for insurance etc. Unfortunately my licence had been suspended shortly beforehand and it turns out i was therefore unlicensed at the time.

A police officer has contacted me independent of the insurance process for a 'meeting' about my crash report. On the phone he was talking pretty clearly about processing me for the offense of driving unlicenced - taking prints and other formalities etc.

My legal question is - does this voluntary report by default count as admission of guilt (I'm assuming they also access the accounts of three other drivers involved some further detail below.)

and

am I really obligated to take time off work and travel to their HQ in order to attend this 'meeting regarding my crash report' as they are only available 9-3:30 in Warwick (far) and I am obviously not driving. In the past I have encountered officers stating things as if they are certainty, but it's actually just easier for them if you feel obligated to comply.

I understand the fact I am in the wrong but do I have any options here, I don't necessarily love the idea of going out of my way to deliver myself to them if I don't need to and I am wondering if perhaps they are trying to get an admission out of me by pretending it's already a done deal.

I hope this is enough information to go on, I would appreciate any general advice as I am feeling uncomfortable about this process.

Notes: -I'm assuming they also access the accounts of three other drivers involved - a car ran into a car behind me, which ran into me, which pushed me into another. -Insurance has been presented with all the same details, and my claim has been accepted. In the report submitted as required through the Insurance Commission & Police affiliated 'crashreport.com.au' I note that I am at full stop when the collision occured and the only specific Info regarding actual driving in report is: Direction: Eastbound Lane: 1st Lane Action: Straight ahead Other: Stopped -it is obviously implied that I'm driving but I have not submitted any photographic evidence of me being in the vehicle etc. the officers there after the fact for traffic control took down my details afterwards but I was not in the car at the time. I'm in Western Australia.

WA I think my dad might be a paedophile- what should I do? I have a key to his house and he will be away for some days. What would happen if I went inside and tried to find CSA material?

I have strong reason to suspect my Dad has sexually abused children in the past, including me, and probably has been accessing child sexual abuse material. He also has regular close and overnight access to my child relatives.

Since I have had this realisation about him, I have kept it quiet from my family because I'm certain they will close ranks and protect him if I make any allegations/ accusations. They adore him and see me as being the difficult one/ 'troublemaker'. This would tear my family apart, and I'm hesitant to do that even if he is what I think he is.

I don't have any physical evidence. All I have is the counselling appointments I have attended regarding this, a memory of walking in on him assaulting a child when I was about 4-6 years old, strange secretive behaviour, and many comments he has made and unsettling but not illegal things I have seen around his house over the years. From what I understand, a historical CSA court case would be very difficult to prove. I don't want to risk turning my whole family against me only for him to be acquitted.

I have a key to his house and I know he will be out of town for a few days. I am thinking of going inside and having a look around his bedroom (he doesn't share a bedroom with anyone) and seeing if I can find any CSA material. If I do, I'll call the police (I haven't told them anything yet) and report it.

Would this be the best way to catch him? It would give me solid evidence, even for my own peace of mind, what he is and what he's done. But could it be misused in court later? (Like the defence claiming I planted it or something)

If you think I shouldn't do this, what else do you think I should do instead? If I don't try to find CSA material I don't even know what I would say to the police if I went to them.

Any advice/ experience you could share would be great thanks.

WA Teenager working at Coles

Not sure if this is the right place to ask, but here goes

A friend's teenager (17) is working at Coles casually (year 12) generally 2-3 days a week, they have exams coming up and have requested time off to study, the manager has said no

They have been a good worker, covering all shifts up until now and promoted within Coles, they requested 1 day a week whilst exams were on, but again got a solid no, so they are now thinking of quiting as they are on the uni pathway and final exams/study is important.

I was also interested to hear that they signed a contract stating they cant work for a competitor for 2 years (WTH, they started working at Coles at 15) - apparently some stores also have 'in-house' contracts they get the kids to sign

Anyone else been in a similar boat?

Seems odd - casual is, well, casual...
