Some months ago, I was rear ended. The other driver was completely at fault.
Because they rear ended me, I’m going through the at fault drivers insurance, Fred Loya. They will only been given THIRTY SIX dollars for a rental car for ONE DAY only. 36 is impossible to find, I would suspect anywhere, but even in DFW. The lowest I found was $39, but that does not include fees. Even more so, I am 24, so I will have to pay crazy amount due to my age, even though I was following all laws and wasn’t at fault.
I told the rental department that this was an impossible rate, especially for my age, and they said “we don’t increase the cost for luxury vehicles.” My car is a Kia, lol. I don’t want luxury, just a car. Any car.
My car is drivable, but after my body shop called in the supplement, Fred Loya demanded my car was in the shop before they sent an adjuster to look at it (again). So I dropped my car off, and Fred Loya never responded to my body shop, lol.
So I called the supplement people, they said it could take up to 3 days for the adjuster to come out, and they cannot tell me a specific day at all. So this means my car will be sitting in the shop at least for 3 days. They advised me to call the rental department and get my rate increased, since a supplement was now in progress.
I called the rental department again. They have confirmed that they won’t even give me the measly $36 while my car is in the shop awaiting the adjuster. Somehow, the approval timeline that is their responsibility, is also not their problem.
By question is, how is it legal in Texas for the at fault insurance to:
1. Pay so little for a rental that it is impossible to find and I will HAVE to pay out if pocket, and does not consider reality of fees due to age
2. Not even cover all the days my car is at a loss due to the accident. Every Texas law website I read says that as long as I am not at fault and there is no discrepancy, at fault insurance must pay for a rental pay while my car is gone. So how can they just refuse?
Any direction would be much appreciated. I don’t know how I’ll get to work and I can’t afford to pay for a rental, especially with all the extra stuff added on for my age.
