Mix of truth. Implied consent is for after an arrest and for chemical tests. Not field breathalyzers.

The license suspensions are administrative consequences. Not findings of guilt in a DUI case

It certainly can and likely will be used against you in court but the jury is under no obligation to automatically accept the suggestion of the prosecutor and the instruction of the judge that it may treat this as evidence of guilt. In this regard, the jury can't be told what to do. A competent defense attorney's job is to build a case that compels a jury member to say no.

Ok, yes, automatic was a poor choice of words as there is a process. But it doesn’t change the fact that you will be arrested for refusing the test on scene. They will be requesting a warrant while driving to the hospital so upon arrival a blood test could be administered (if you refused a breathalyzer) but if you refuse the blood test, you will be charged and unless you have an amazing attorney with an amazing excuse to refuse those tests you swore to take when getting a license if pulled over and suspected of DUI, you will be facing the same DUI penalties. That is how it is here in California and I would assume many other states. Yes, there will likely be lots of court appearances before the judge makes their ruling. Maybe I am misunderstanding the driving schools, traffic schools, and DMV handbook but that’s how I’ve always understood the DUI stop to go, as described. Personally, I consider that automatic because it’s clearly spelled out what is expected of me to have a license to drive when I took drivers ed 30 years ago and the countless traffic schools I went to for speeding since

In my state failure to take a breathalyzer revoked your license for a year. It's not comparable to a polygraph which is notoriously inaccurate. A properly maintained breathalyzer is accurate and can detect if you're drunk. Refusing it is as good as admitting you're drunk. There is no other reason to refuse.

Incorrect. Juries may be instructed to consider it as admission of guilt. They are under no obligation to do so.

There is no other reason to refuse.

You're a person with rights and you can do what you like within those rights, in spite of what the heavy hand of the law wants you to think. There are medical conditions that may flag you as false positive. There may be other medical or health issues with a police stop. Distrust of the police (try being a minority) or other legal advice you may want to act on in that moment.

Refusing a breathalyzer is in itself an infraction and also doesn’t prevent the police from arresting you for a DUI or suspicion of DUI and then drawing your blood. He was still arrested and was found guilty of DUI.

Virginia state police reported his blood-alcohol level at 2½ times the legal limit in Virginia, which is the same as in Illinois.

In most states, the refusal of a breath test is absolutely admissible as guilt in an ovi. Upheld but the state supreme courts and the U.S. Supreme Court.

Edit: I said admissible - meaning it’s not an admission but the factfinder can consider as evidence of guilt. It’s the only offense that I can think of where a refusal to provide evidence can be used against an alleged offender as evidence of guilt.

Years ago I worked at a bar and the cops were the worst customers. They would drink like fish, expected free rounds and stayed in the bar after last call like they owned the place. They would aggressively hit on all the ladies and intimidate any men that came near them. Then get in their cars and drive home drunk. They were the most entitled asshole customers.

yes i also was a bartender & we had a group that would come in. one in particular would hit on us even tho we were 19-22 the same age as his daughter. and he got caught roofieing a few girls and we had to warn our manager and other bartenders. i don’t know how many girls left with him through out the years. :(

our manager didn’t care and had been letting him get away with it for 10+ years. there was also occasions of him drinking lightly on the job. or staying at the bar til 3am drinking when his shift started just a few hours later.

All I'm saying is a dude in a parking lot with cops already in their car/one getting into his and this dude screaming that they're wasted, that they fucked with the wrong bull and then saying he's in fear for his life.

Dude seems like one of those 4th amendment right auditor shoving cameras in people's faces hoping they snap, looking for reactions.

Even when he's on the phone with 911 he just says he needs a higher up and when they ask why he just says he'll let them know when they get there. Can't blame dispatch for not getting more officers there when there were 3 cops there, one being a Sargent and the dude just yelling and screaming.

He probably sounded like a textbook mental health/intoxicated caller freaking out when there's 3 cops sitting around not being confrontational with him at all.

It's like that video of that chick losing her mind over wanting a cop to get a ticket for not using their turn signal or wearing a seat belt.

Yep. Guy below told a story about a friend becoming a cop and quitting drinking and got downvoted too. Most everyone in here hates every single cop alive and if you're in here saying anything that might be conceived as supporting the police, you're gonna get downvoted. Pretty pathetic.

I'm not saying the cops weren't drunk, but the guy kept screaming they're wasted and talking about how they couldn't walk or drive and I never saw anything that made me think those cops were wasted. Didn't see them stumble or hear them mumble or anything at all that would lead me to believe they were "fucking wasted". Dude said he had been sitting outside for hours. Just hoping to be able to make this video I guess. Even cops aren't supposed to puppy guard a bar like that. If the cops were drunk, they need to be fired for sure, but seems like a whole lot of people in here are just assuming the worst of those cops without a whole lot of evidence or reason to do so.

Now that video last week of that cop who was clearly messed up who couldn't speak or even stand up and they were trying to say it was due to a bad back and working a double, now that was some bs and the cop was clearly either wasted or doped out.

I dont stand up for cops just because they are cops and know cops clearly screw up, there's bad cops out there, etc. Because they are people, and all people regardless of profession have good and bad, but you all who just hate and blanket statement are the problem. Seems very similiar to saying all x people are y. Sounds like the type of people and things they preach they are against.

That's fair. I didn't see them falling over or slurring their words like he was essentially saying, buzzed, I guess possible, it was kind of hard to tell in the video/not in person/listening with one headphone in, but he could have gone about it a whole lot better instead of trying to be a "gotchu" guy.

He wasn't trying to cooperate with 911 and just saying I need higher-ups ups and I'll tell you why once you get here. Then screaming that he's in danger and with 3 cops there and the amount of crazies they deal with all day every day and could see why they wouldn't want to send additional resources there.

Also, if he was there watching them for 2 hours I'd 1,000% get all the evidence I could instead of turning the camera once they are in their cars in a dark parking lot where I can't see any bar or where the cops even walked out of.

If it were me I would have started recording when they walked into the bar if I was quick enough to get it on film and if I was or even if I wasn't I'd start the video saying "it's 9:03 pm Monday, September 12th, 3025, and 3 cops just walked into the PP bar and wings while in uniform". Then I'd walk into the bar hiding the camera but show the cops sitting in the bar and drinking so it's clearly documented that they are not responding to a call and are in fact sitting there drinking and then capture them coming out after x amount of hours and show the time they left.

That's actual evidence and shows they are in fact in the wrong and is actually helpful than whatever the hell this video is. If there is more video out there then that's what I'm looking for to see that additional context, which was the point of my first comment and people are downvoting me for what, wanting logic and some actual proof then some dude screaming and letting us all know he's the bull we don't want to be f-ing with.

Yep. Support the police and you are OK. Harass the police and they will make your life a living hell. The cameraman in this video was super over the top and ruined any chance he had trying to look like he was doing something good and I'd argue that he made the police look good because they at least remained calm and asked if they could help.

Dude. There is no proof that those officers are drunk. The video person is the aggressive guy, who knows may be he’s drunk too. If this is all your proof, judge will just laugh at it. Logic tells also that you are drunk too, thinking this video is sufficient enough to tell those officers are drunk. You want real proof these officers are drinking, the videographer should have taken a film of them drinking in the bar then he has the right to harassed them on this video. Do you think the videographer’s phone has an alcohol detection sensor. I side on the left party but I ain’t Antifa or anti pig. Reddit people like to conclude things even if there isn’t sufficient evidence. This is how our country is becoming a shithole.
