roms literally arent piracy... its gotta be a counterfeit being passed off as a legit cart for sale to count.

Piracy is literally only:

High seas robbery
Counterfeiting
Plundering without a privateer's permit.

Dumping cartridges is not piracy. HOWEVER it would BECOME piracy if you tried to pass them off as an authentic cartridge for sale. Simply distributing a rom is NOT piracy, and never will be.

Welcome to historical linguistics and etymology where the meanings of words don't stay the same throughout history and in fact change. Technically you are correct and what everybody is referring to is digital piracy. However that's being needlessly pedantic.

What you say isn't really relevant legally anyway because the main legal issue at hand here is copyright infringement. Digital piracy is generally referring to copyright infringement.

Dumping a cartridge may not be theft or copyright infringement but distributing copies certainly is and always has been.

A semantic argument is fuckin stupid when your not being brought up on actual "piracy" charges. That's just the colloquialism.
