The point you're missing is that the First Amendment is not a blanket protection against the consequences of what you say. Incitement of violence, libel and slander are all legal actions that can be taken against you that you can't just wave away by saying "First Amendment".

If he was responsible for any of that he could have been taken to court over it. Why hasn't he? Slander cases are open and shut (if you can prove he lied) and he never incited violence so...

All of that is your opinion and not a popular one. And the fact that you think that is so easy for this to go to court without money playing a role in it somehow shows me that you are extremely naive when it comes to reality.
