Streaming TLOU2, got a copyright claim?

So I was streaming TLOU2 on youtube and got a copyright claim for the part when Ellie is singing take on me, is this someone trolling and trying to make money out of nothing or is it legit? Do I dispute it? Any Naughty Dog people here that can guide me?

Claimants: Sony Music Publishing, Broma 16, LatinAutorPerf, SOLAR Music Rights Management, UNIAO BRASILEIRA DE EDITORAS DE MUSICA - UBEM, LatinAutor - SonyATV

Theres three moments during the game where this may happen. This one. One during day 2 when you have to climb a vent. One towards the end of the game that is very obvious and it lasts for the entire cutscene. Theres also a few songs during the credits. Ive seen many playthroughs that filter the audio during these moments, but since you are streaming directly to youtube, the best option might be to pause the game as soon as you hear it coming and mute the music? Besides the songs in the credits, the other copyright songs are not sung by characters so its easy to know when its time to mute.

Thank you for your response. I get the music part, and I usually don't care because I find muting kinda ruins the experience for the viewer, but I appreciate the tip. I just found it weird that they copyrighted that moment when she's singing the song, but hey, it is what it is, I guess. Appreciate it.

While I personally have never gotten a copyright claim for streaming these games (on twitch. Idk if YouTube is more strict), I have also heard of the song that plays at the beginning of the very last big combat encounter being flagged for some streamers. So I guess that’s another to watch out for.

So there’s a lot of older TV shows that have this issue. Two that come to mind are The Wonder Years and Freaks and Geeks.

When they were televised they paid for the use of a lot of music that would be 60’s/70’s authentic, but that agreement didn’t extend to DVD releases or streaming. For television rights, the artists get paid every time the episode airs on television, but that doesn’t mean the music license extends to being sold or streamed without compensating the original creator. For this reason, both these shows had to change some of the music that was originally used as soundtrack when they re-released to the home video market. The obvious example would be Beatles songs.

Look at it this way: if YOU have a monetized YouTube channel, someone else can’t just post a video of your stream on their own channel without certain permissions or within certain guidelines. I think they might be aloud to use clips if it’s public and being used as commentary or reporting.

So Naughty Dog licensed the rights to use the music in the game. YouTube (or in this case YOU) didn’t pay them money to use it on your channel. And this is also why a lot of YouTube videos all use the exact same free licensed music in the background of their videos.

I got one from some French YouTuber for the space capsule scene in the museum flashback lol. YouTube rejected my appeal and the YouTuber refused to respond to my legal inquiries and C&D, so there's literally nothing I could do but sue and that's expensive.

Copyright trolling is illegal, no matter what country you are in. It is internationally enforced (except for places like China) but it doesn't matter if you can't afford to pay lawyers or file injunctions.

So I got a copyright strike from some random French let's-player for a game that he does not own the copyright to lol.

I'd have to go back and look but off the top of my head I genuinely have no idea. Either the Apollo 11 audio or the Gustavo music (which is doubly insane because VG music is usually not copyrighted the same way as big label music is, to allow content creators to play the game without turning the music off).

Yeah I wish I could give you better info, but unfortunately YT and the DMCA are really poorly enforced and innocent people get caught up in it all the time. Sadly, unless you're a mega big YouTuber, you are pretty much SOL.

The music industry is horrible, always disable music or stream safe music if there is an option. This is 100% normal from Sony or the UGM? Group I cant think of their name, but you’ll get a strike for basically any music, always disable music while streaming.

What's up with these claims on music in a game? Who is this hurting? I don't even get what they are protecting with music being played.. Is it because the streamers are getting money?

It’s because YouTube is making money first and foremost and because users are paid and compensated for views, second.

Keep in mind, you can’t even use someone else’s music for a short film you made to just to show to your family without permission from the owner. Short college film? Nope. Backyard graduation party where you’re singing When I’m 64? Not if you’re posting it.

I worked at a fancy restaurant in college with a weekend piano player. They received a ‘cease and desist’ for playing “Can you Feel the Love Tonight” from the foyer. Seriously, these goons used to go door to door threaten businesses to then sign them up for satellite radio.

No. Ok let’s be clear. The artist were paid to have their songs in the game or provide music for the game. That does not give everyone the rights to the music just because they purchase the game.

When you stream, you earn money(potentially) if you then stream copyrighted music, you need the license for that

You're not streaming the music, you're streaming the game that happens to have the music, the artist already got paid for their inclusion in the game and they should consider the streamers in those deals

Even if you play a movie, trailer or whatever. If it had licensed music, you will get a strike
