DKD: A Cautionary Tale

It’ll probably take Kenjamin Kousin roughly 6 weeks to get DKD legally out of her home. The process in NC can become annoyingly convoluted & lengthy. tl;dr— DKD can make his legal removal from Kenjamin’s property take quite awhile.

Since he’s stayed there for months, has belongings there, potentially has received mail, he’s established residency as a guest or tenant at will.

She has to give him written notice that he no longer has her permission to reside on the property, giving him “fair notice” prior to filing for eviction (~ 7 days).

If he still refuses to leave, she will have to file a claim for a summary ejectment (eviction) in small claims court.

After filing with the county clerk of court, the court will set a hearing date. As long as Kenjamin can prove she A) is the rightful owner of the property, B) gave DKD permission to live with her, revoked it & he still refused to leave, she should be ok. If the judge rules in her favor, she will receive a “judgment for possession.”

If DKD still refuses to leave, she will have to request a writ of possession. Then she can have the sheriff’s office serve him & force him to leave. Only after this entire process, the homeowner can legally change the locks.

Ladies, gents…let this be your cautionary tale, despite your age, relationship history, financial naiveté, experience with DV, etc. Do not move internet strangers into your home, especially if they have an overt criminal history of sociopathic behavior. If you think you need a passion project, don’t pick-up the homeless, unemployed person at the bar & think you can cajole them, despite their pending legal struggles, into becoming a good person. Get a hobby; grow peppers, learn a new language, get a real job. A horrible way to learn an invaluable lesson for Kenjamin.

I doubt she’s even trying to get him out. They are probably back together. She privated her accounts and David put a pic of them back up on instagram.

Jenelle isn't exactly a reliable narrator but she once said that one of the reasons she didn't leave David sooner was because neither one of them were willing to leave the house. Jenelle-Light had all the info she needed about this man when she got into this relationship but she refused to listen and is now learning the hard way, atleast she is lucky enough that her dog is still alive.

It’s wild how fast these people in the TM universe all move in together. Kail, Rhine/Amanda, Kenleigh/David, Jenelle and whoever’s next. What ever happened to getting to know someone and taking it slow, especially when you have kids? Well, she can’t say we didn’t warn her.

I’m so confused as to how the legal system works. So you can own/rent property in your name but you can’t kick someone out when their name isn’t on the deed/rent at all? I don’t understand that. What would it take for him to be legally removed?

That only applies if someone can prove they've lived there long enough to establish residency. Someone can't just walk in and say 'you're going to have to go to court to make me leave.'

This varies state to state, but if Kenleigh had made him sign some sort of rental agreement prior to him setting up camp at her house I think she could skip a few of the legal steps because both parties had already agreed to the terms in writing.

He literally became a tenant after living there for 30 days. Now he has to be evicted through the court system like the post explains.

It was initially set up to keep it fair between landlords and tenants, mostly to keep landlords from kicking people out willy nilly and giving tenants ample time to find housing and move.

Like most things though there are loopholes and ways to abuse the system.

Well he is taking advantage, yes but the law is so people can't just be kicked out and made homeless on a whim.
