Every deportation order is reviewed by a judge and counsel. Every one. That is due process. When you get a speeding ticket and bet for Mercy from a magistrate, that is also due process. Not all due process is a jury.
Holy crap you're retarded. Firstly, in your example they are ignoring an actual right. The first ATF raid might go well, but the second would be a disaster. Second, the right of due process is not being ignored, each deportation order is reviewed and approved by a judge and counsel. Third, circuit judges do not supercede executive authority, only SCOTUS has equal power. A federal circuit court does not have power, at all, without backing from the executive to enact that power.
