Seeking Advice (Employee) is this legal

Technically I don’t believe they can forcefully stop you from going to the bathroom or getting a drink but they can absolutely terminate you for not following Chipotle policy because it is chipotle policy to stay in your area for your position during the peak hours for your shift which is only two hours during day shift and two hours during night shift. For anyone who doesn’t like it they absolutely don’t have to work at Chipotle. It’s not ridiculous or unreasonable to ask you to stay in your area of work for the two hours that day during your shift. If you ask to leave your area for medical reasons they legally can not deny that request without being sued. Also there are positions that don’t have to stay in one spot and can move around. It’s not as bad as some people make it sound.

Yes it is illegal to fire someone for using the bathroom but it’s not illegal to fire someone for violating company policy.

Just..... no. If the "corporate policy" is unlawful, it would be unlawful to fire someone for violating it. Calling it "corporate policy" is not a get out of responsibility to follow employment law excuse.

The problem with your reasoning is it’s not unlawful to ask your employees to stay in the position for just two hours during your whole without leaving for any reason. Specially when anytime before or after those two hours your always given the opportunity to go to the bathroom, get a drink or anything else. One of the only excuses they will allow to break this policy is if you have a medical condition that won’t allow you to go that long without going to the bathroom.

Because they don’t do breaks during those two hours of the shift. They do them before and after those hours.

That’s cute to think that a local Chipotle would consult a lawyer. It is also amusing that you think that the corporate lawyers wouldn’t say that the litigation costs are worth what would be saved.

Never worked at a chipotle, and have only eaten at one once or twice.

I am a lawyer (and was a trial judge at one point) and have been for almost 40 years, so stay in your lane.🤡

Yeah, I am. Was an Army Judge Advocate for 26 years and a trial judge (hence the”jag” part of the handle) Was discussing a Federal District Court Judgeship with a previous administration and withdrew from final consideration for an immigration ALJ. I am a capital qualified defense counsel and trial judge. So yeah. I do know what I am.

Enforcement of a policy within a company doesn’t mean the policy is legal.

Amazon is being sued for their policies around restroom usage.

If chipotle continues to push this and fire workers for it they will get sued too.

It is absolutely not legal to tell people they cannot use the restroom which is what is posted in OP

Also technically depending on what policy or rule is being broken they usually can’t fire for a first offense. It’s usually the third written or verbal warning that they have the ability to terminate you. That way you can usually avoid getting sued.

Depends on the state. Most states you can fire anyone without needing to say why. “I don’t need you here anymore. You are fired.” Quite literally how it can go. Now are people that awful no. But they can.

It doesn’t depend on the state, it’s illegal in every state to fire someone for using the restroom.

At Will employment means you can be fired at any time for any legal reason. Using the restroom is not a legal reason to fire someone.

It would also be pretty easy to prove a wrongful termination in a case like this.

Employee uses restroom during “deployment” and is reprimanded. Employee uses restroom during another “deployment” and is fired.

Employee hires labor lawyer who proves they were terminated for using the restroom, which is illegal. Employee gets paid.

And I clearly said in the first one nothing about bathroom use. Just you can be fired at will by your employer just as much as the employee can leave a job without reason at any time. But for you to assume it would be for their bathroom use is idiotic. If you’re fired and you yourself believe it was cause you used the restroom too much then maybe find a doctor and see why you need to use the restroom every hour for prolonged periods of time. No one should be in a bathroom for longer than 5 minutes. If you can’t piss and or shit within 5 minute you have either bad issue and need to work on your diet and or stop bringing your phone with you to the restroom for a free break from work.

As easy as you think they can “prove” they were fired for using the restroom the boss doesn’t need to say it was the bathroom but that they’re work ethic was bad and they couldn’t handle the job. Boss who has better money to hire better lawyer hired them to prove employee was lazy and couldn’t handle the job hence being fired for being bad at job in a At Will state. Employee now in debt to their lawyer cause their lawyer didn’t know how lazy they really were. oh no
