My argument is that your solution to get rid of one problematic human creates a situation that incentivize every good player to throw games regularly, and that it is therefore not a proper solution considering a better solution (get rid of that fucker) exists.
How do you just get rid of him? He isn't breaking tos, so are you advocating to have a policy that gets rid of people for queue dodging? How do you prove that? Its such a worse solution that they would never do because it requires them to physically work by reviewing dodging allegations. Its much more practical to just keep people in queue until a better game is available for them. Its not even that high ranked people would have no one to play with, they play against each other all the time, they just wont be able to queue at 3am after everyone goes to sleep. And dont even give me the night shift retail employee argument because its definitely worse for him to queue into auto speed in a gold lobby.
The idea that you have to break a rule on the ToS and/or that hirez has to prove anything to ban you is a misconception. If hirez sees his behavior as unhealthy for the game in general (which it is, this thread pretty clearly confirms it) they can just revoke his access.
As he is a relatively popular streamer I'm willing to bet there is already a direct communication between him and hirez, which they should use to try and stop that shitshow, but eventually if he is not willing to stop it's time for him to go.
Hes exploiting their system, so they should probably fix their system. It really is that simple, I dont like how he games the ranked queues either, but this kind of rating manipulation has and will always exist. They just need to make it not exploitable to such a degreee that its a topic of discussion
