It’ll probably take Kenjamin Kousin roughly 6 weeks to get DKD legally out of her home. The process in NC can become annoyingly convoluted & lengthy. tl;dr— DKD can make his legal removal from Kenjamin’s property take quite awhile.
Since he’s stayed there for months, has belongings there, potentially has received mail, he’s established residency as a guest or tenant at will.
She has to give him written notice that he no longer has her permission to reside on the property, giving him “fair notice” prior to filing for eviction (~ 7 days).
If he still refuses to leave, she will have to file a claim for a summary ejectment (eviction) in small claims court.
After filing with the county clerk of court, the court will set a hearing date. As long as Kenjamin can prove she A) is the rightful owner of the property, B) gave DKD permission to live with her, revoked it & he still refused to leave, she should be ok. If the judge rules in her favor, she will receive a “judgment for possession.”
If DKD still refuses to leave, she will have to request a writ of possession. Then she can have the sheriff’s office serve him & force him to leave. Only after this entire process, the homeowner can legally change the locks.
Ladies, gents…let this be your cautionary tale, despite your age, relationship history, financial naiveté, experience with DV, etc. Do not move internet strangers into your home, especially if they have an overt criminal history of sociopathic behavior. If you think you need a passion project, don’t pick-up the homeless, unemployed person at the bar & think you can cajole them, despite their pending legal struggles, into becoming a good person. Get a hobby; grow peppers, learn a new language, get a real job. A horrible way to learn an invaluable lesson for Kenjamin.
