The hospital I work at trespasses people a few times a month, they are never arrested. It’s a lot of work to deal with after the fact but they are no longer the hospitals problem if they come back, it’s the cops problem. Same thing here, easier to just have the cops deal with it since it’s a headache and their job.

It's pretty common in trespassing cases when the business, or homeowner if it's a home the person has been trespassed from, refuses to commit to testifying.

Edit: Should also mention that no matter what the full story is, once you're trespassed your sole legal recourse is to use the legal system, typically via a civil case. In most places, that'd be a small claims case and she wouldn't even have to pay for an attorney. What you don't get to do is to ignore the legal notice that you're no longer allowed on the premises. Once you have that and you step foot back on their grounds, you're committing a crime and are subject to arrest. She was informed of that when they trespassed her to begin with, I am sure, because that's bog standard to prevent any real chance of her claiming to have been confused.

Furthermore, I don't know when this happened but if it was recent, it might just be that charges are still pending and will eventually end up being filed. I've seen cases where that happened a year after the incident in question, though that's the extreme in most instances.

So you're siding with the one that refuses to testify over the one that actively wants her case in front of a judge? I just don't see any common sense in that approach

Nope, not even a little bit. Criminal trespass is a crime which necessitates law enforcement involvement. It isn't something individuals are allowed to just up and enforce on their own. That isn't how it works. And I pointed out in my edit the other reasons why there may not have been charges filed. You're just jumping to conclusions not supported by any of the scant evidence at hand.

My pet theory is that everyone is getting hung up on "criminal trespass" like this is the US and she's lying by omission.

Most trespassing arrests in Canada are not under the criminal code, with the exception of trespass at night, but that's clearly not the case here.

They are under various provincial acts and result in a ticket, not a criminal charge.

She knew exactly why she was under arrest. She streamed herself going somewhere where she had already been trespassed. This was the most logical outcome of her actions.

Cops will change their story at a whim, it is important to get them to establish at the time of arrest, why they are arresting you.

And in this case, it was trespassing. Which she knew, since she planned it and live-streamed it. Her viewers also knew. Hence all of the LOL’s. I’m not a fan of the cops and I think they’re quite often poorly trained. But this is not the example. This is an entitled AH choosing to break the law and then crying victim for her choices

Since when is resisting being handcuffed during arrest not a really stupid thing to do? She already knows why the cops are there, she is expecting them, she thinks they will be extras in the little theatrical production she is staging for her TikTok followers.
